Stricter HMO rules set to be introduced

Stricter regulations on converting properties into houses of multiple occupation (HMOs) look set to be introduced in parts of the district - if Wakefield Council’s key decision makers give the go ahead at their meeting next week.

Senior councillors will be asked to agree to introduce an Article 4 Direction to curb the rise in smaller HMOs. This follows public consultation on the proposals in November 2024.

“There has been increasing concern in recent years at the growth in the number of HMOs in our district. It’s very important that we have a mix of housing options in our area and, in particular, that we have a good supply of housing for families.

“Having too many HMOs in a place can be difficult to manage. With impacts on our roads and other local transport infrastructure. Increased strain on our public services. And it can cause big changes to the character of an area very quickly.

“These new regulations will improve the wellbeing of our communities by ensuring a range of factors are considered through the planning applications process and will help make sure we all have a place we’re proud to call home.”

Currently, planning permission is required for larger HMOs, but it is not required for properties to be occupied by between three and six individuals.

If confirmed, the Direction would mean such proposals would require planning permission from 24 October 2025 when the Direction would legally come into effect.

The rules are proposed to take effect in areas of Wakefield and Castleford where evidence demonstrates there are higher concentrations of HMOs.

The introduction of the Article 4 Direction does not impact on existing HMOs in the affected areas. It will only apply to proposals for new HMOs.
The impact of the new rules will be closely monitored going forward. Including to see if there is any effect on neighbouring areas.
