Description: I am writing to make a request under the Freedom of Information Act 2000 in relation to Section 106 planning obligations connected with the former Glasshoughton Colliery site, Castleford, off Junction 32 of the M62. I understand this site was developed in a number of separate phases between approximately 1998 and 2020, including a stadium/sports ground, a leisure complex including an indoor ski slope, factory outlet retail units, housing, and employment and further education uses. The original development partner was The Glasshoughton Stadium Company Limited, which changed its name to Waystone Developments Limited (company number 06585062) on 10 November 2011. For every Section 106 or Section 106A agreement entered into by the Council in connection with this site, under any planning application reference, and by any developer including but not limited to The Glasshoughton Stadium Company Limited, Waystone Developments Limited, or any predecessor or associated company, could you please provide: a) the planning application reference number; b) the date the agreement was signed; c) the full legal name(s) of the developer(s) and any other parties to the agreement; d) a list of all financial contributions secured under the agreement, with their stated purpose (for example education, affordable housing, highways, open space, employment or training); e) the amount paid to date against each contribution; f) the amount, if any, currently held unspent against each contribution; g) any clawback, repayment or long-stop provision applying to each contribution, including the date by which it must be spent and the consequence if it is not; and h) any interest accrued on unspent sums, and any refunds already made to the developer or its successors. If it would be more practicable for the Council to provide this information in the form of its internal Section 106 monitoring spreadsheet or database, covering the site described above, rather than agreement by agreement, I would be happy to receive it in that form. A spreadsheet format (for example Excel) would be particularly helpful given the likely number of separate agreements. For context on why this information is of public interest, Wakefield Council's own published Infrastructure Funding Statements report a district-wide unspent Section 106 balance running into the tens of millions of pounds, and the Council has previously provided comparable Section 106 payment and commitment data in response to a Freedom of Information request (Ruth Hayhurst, regarding payments 2008/09 to 2012/13), so I understand this is information the Council is able to compile and has done before.
