Private Streetworks Procedure

Summary of the private streetworks procedure.

  1. Owners are consulted and the street is considered for entry on a  programme.
  2. The Council pass a resolution to make the street up.
  3. The Council approve a detailed scheme.
  4. Scheme is advertised and owners are told how much it is estimated it will cost them.
  5. Owners may object to the Council on certain grounds.
  6. Objections are considered by the Council.
  7. Objections not resolved are referred to a magistrates' court.
  8. If the court allows objections, the Council reconsider the scheme.
  9. If the court dismisses objections, the Council asks for tenders from contractors to do the work.
  10. The successful contractor carries out the work.
  11. When work is finished, generally owners are told how much of the cost they will actually have to pay after this maintenance period is complete. There is a twelve month maintenance period. 
  12. Owners may object to the Council on certain grounds.
  13. Objections are heard by the magistrates' court.
  14. Accounts for payment are rendered.
  15. Appeal may be made to Minister of Transport, on certain grounds.
  16. The decison made by the Minister is final and not open to appeal.
