Occupation of road in connection with building work - licence

If you wish to place building materials on any part of the highway a licence is required from the council under Section 171 of the Highways Act 1980.

Only if it is not possible to avoid using the public highway, then the materials should be placed in the carriageway, rather than the footway. All materials placed in, or partly on the carriageway must be signed and guarded in accordance with Chapter 8 of the Traffic Signs Regulations and General Directions and the Code or Practice - Safety at Street Works and Road Works.

Building materials placed on the highway should not obstruct or interfere with the drainage of the street or with any apparatus of any public utility companies.

The charge for a Building Materials Licence is currently £75.


Will Tacit Consent Apply?

Yes. This means that you will be able to act as though your application is granted if you have not heard from the local authority within a reasonable time period of seven days
