Statement of Community Involvement

The Statement of Community Involvement (SCI) explains how the community and organisations can take part in the planning process. It sets out how the Council will engage with people and organisations when preparing the Local Development Framework and considering planning applications.

The Council submitted the SCI to the Secretary of State for consideration in July 2005 and has carried out a final six week period of public consultation. An independent Inspector was appointed to hold a public examination to consider the soundness of the SCI and any representations made. As part of the examination the Inspector held a hearing on 1st December 2005. The Inspector’s binding report has now been published and can be viewed and downloaded by clicking on the link in the right hand column (To download a document to your machine, right click and then choose ‘Save Target As’ if using Internet Explorer).

The Council has amended the SCI in accordance with the Inspector’s recommendations, and adopted the SCI on 8th February 2006. A copy of the adopted SCI can be viewed and downloaded by clicking on the link in the right hand column.

The adopted SCI and Inspector’s Report are also available for inspection at main Council offices and libraries. See below for details of these venues and the statutory notice of adoption.

NOTICE OF ADOPTION OF THE STATEMENT OF COMMUNITY INVOLVEMENT (SCI)  AND PUBLICATION OF THE SCI INSPECTOR’S REPORT

In accordance with the Town and Country Planning (Local Development) (England) Regulations 2004 (Regulations 35 and 36) the following information provides details about adoption of the Statement of Community Involvement and publication of the Statement of Community Involvement Inspector’s Report.

The SCI sets out how people and organisations will be involved in the preparation and review of the Local Development Framework documents and in considering planning applications for the area of Wakefield Metropolitan District.

On 8th February 2006 Wakefield Metropolitan District Council adopted the SCI.

A person aggrieved by the SCI may make an application to the High Court under Section 113 of the Planning and Compulsory Purchase Act 2004 on the ground that the SCI is not within the appropriate power or that a procedural requirement has not been complied with. The application must be made not later than the end of the period of six weeks starting on 8th February 2006.

A person aggrieved by the SCI may also make an application to the High Court for permission to apply for a judicial review of the decision to adopt the SCI. Any such application must be made promptly and in any event not later than three months after 8th February 2006.
