Pollution Prevention and Control - environmental permitting

You must have an environmental permit if you operate a regulated facility in England or Wales.

A regulated facility includes:

  • installations or mobile plants carrying out listed activities
  • waste operations
  • waste mobile plant
  • mining waste operations

Certain industrial activities are prescribed for regulation because of the nature of the activity or the substances they use or emit. Activities are regulated under the Pollution Prevention Control Act 1999 and Environmental Permitting Regulations 2010.

Under the system operators of prescribed industrial activities are required to apply for a Permit. If the application is successful, a Permit is issued with a number of conditions attached. These conditions are legally binding and are designed to ensure that the activity is carried out in such a way that emissions are minimised. In order to make sure that the operator complies with the conditions the operator receives regular visits from the regulator.

There are various categories of industrial activity under the Regulations:

  1. Part A1 Activities. These are regulated by the Environment Agency with respect to emissions to air, land and water plus a number of other environmental considerations (IPPC). 
  2. Part A2 Activities. These activities are regulated by councils with respect to emissions to air, land and water plus a number of other environmental considerations (LA-IPPC).
  3. Part B Activities. Also regulated by councils, these are regulated for emissions to air only (LAPPC).
  4. Waste operations.  The Environment Agency regulates the following waste operations:
    • Waste operations carried out at Part B installations;
    • Waste operations or waste mobile plant, other than at an installation or by Part A or B mobile plant;
    • Mining waste operations.
