Smoke from a bonfire is affecting me

If you are affected by smoke emissions we would ask you to approach the person causing the smoke and let them know how the smoke is affecting you. 

Our experience has shown that people usually respond better to being approached by a neighbour rather than a letter or visit from an official. You may request a pack from us with some ideas on how to do this for example a simple letter you could use to send them. 

Formal action that can be taken for regular or persistent smoke emissions

There are no specific laws to stop residents having bonfires however if smoke from a bonfire is causing you a problem then this may be a “statutory nuisance” that we can deal with.  Initially we will contact your neighbour by letter to advise we have received a complaint and explain about smoke nuisance.

If the problem continues then an Environmental Health Officer will visit the person responsible and discuss the complaint.

If there is no improvement the officer will monitor the smoke problem and determine if a statutory nuisance exists or is likely to happen. They may issue an Abatement Notice requiring the person responsible to stop causing a nuisance. If the person fails to comply with the notice they can be prosecuted by us and the Court may fine residents up to £5,000.
